When can a sponsor annul a Certificate of Sponsorship?

A sponsor can annul a Certificate of Sponsorship if the role associated with that certificate is no longer available. This means that if the job position for which the employee was sponsored has ceased to exist or has been eliminated, the sponsor has the authority to withdraw the sponsorship. The rationale here is that the certificate is directly tied to the employment role being offered to the non-citizen; if that role is unavailable, the sponsorship cannot continue.

In contrast, while a company merger might lead to changes in sponsorship capabilities, it does not automatically justify annulling an existing certificate. Similarly, the passage of time, such as one year of sponsorship, does not trigger an annulment, nor does an employee's request to leave guarantee the termination of the sponsorship. The key factor for annulling a Certificate of Sponsorship is the actual availability of the role for which the certificate was granted.
